Judge Strikes Down Biden-Era ‘Gender’ Employment Rule

A federal judge in Texas has issued a ruling that prevents certain aspects of the Biden administration’s Equal Employment Opportunity Commission (EEOC) guidance from taking effect, specifically those that broaden Title VII protections to encompass sexual orientation and gender identity.

Judge Matthew Kacsmaryk, appointed by Trump, determined that the Equal Employment Opportunity Commission’s interpretation of ‘sex’ under Title VII is ‘in violation of the law.’ This lawsuit was initiated by the conservative Heritage Foundation, which contended that the guidance compelled businesses to adopt ‘extreme gender ideology.’

Texas Attorney General Ken Paxton lauded the decision as a victory for ‘biological reality,’ whereas the EEOC pointed out that it does not have a quorum to officially withdraw the guidance.

Critics argue that the decision undermines protections for LGBTQ+ employees, whereas proponents assert that it maintains legal clarity and rationality.
